Terms of Service for NanoBananas

1. Acceptance of Terms & Binding Agreement

Welcome to NanoBananas ("the Platform", "we", "us", or "our"). By accessing nanobananas.si, registering an account, or purchasing creative credit packages, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you must discontinue your use of our service immediately.

You represent and warrant that you are at least 13 years old (or the legal age of digital majority in your jurisdiction). If you are using this service on behalf of an entity, you confirm that you have valid authority to bind that entity to these Terms.

2. Description of Service

NanoBananas delivers creative synthesis and image manipulation workflows powered by generative AI models:

• Text-to-Image synthesis from descriptive natural language prompts.
• Image-to-Image editing, stylistic transformation, and background replacement.
• Character fidelity preservation and multi-image context guidance.
• Ultra-high-definition image downloads up to 4K native output.

3. Account Registration & Security

To access core features and credit balances, you must authenticate through a registered user account:

• You agree to provide true, current, and complete registration credentials.
• You are solely responsible for maintaining credential secrecy and all actions executed through your account.
• Promptly report any suspected security compromise or unauthorized access to support@nanobananas.si.

4. Acceptable Use & Zero-Tolerance Content Policy

You covenant and agree that you shall NOT use this platform to upload, prompt, synthesize, edit, or circulate any of the following:

• Child Exploitation & Abuse (CSAM): Any imagery, prompts, or depictions involving the sexualization or abuse of minors are strictly prohibited.
• Non-Consensual Sexual Imagery & Deepfakes: Creation of non-consensual intimate imagery, sexualized likenesses of real individuals, or defamatory deepfake content is forbidden.
• Terrorism, Extremism & Severe Violence: Depicting real-world slaughter, self-harm encouragement, instructions for creating illicit weaponry, or promoting terrorist groups.
• Hate Speech & Harassment: Inciting violence, systemic discrimination, or personal harassment against protected groups.
• Intellectual Property Infringement: Uploading copyrighted assets or trademarks without verifiable legal ownership or authorization.
• Infrastructure Abuse: Reverse engineering API endpoints, deploying scraping bots, mounting DDoS vectors, or purposefully evading safety guardrails.
• Google Generative AI Policies: Full adherence to Google's Generative AI Prohibited Use Policy.

5. Intellectual Property & Commercial Usage Rights

We empower creators with full commercial freedom:

• Your Inputs: You retain complete ownership of prompts and source graphics you submit. You warrant you have all rights and consents necessary to upload your materials.
• Commercial Output Ownership: Conditioned upon full compliance with these Terms, you own and hold complete commercial usage rights in all outputs generated via your paid credits. You may reproduce, distribute, monetize, and exhibit your generated imagery across personal, marketing, and commercial client engagements.
• Platform Property: The software, algorithms, user interfaces, branding, and assets of NanoBananas remain the proprietary property of NanoBananas.

6. Creative Credits, Payments & Refunds

Our services are billed on a flexible Creative Credit Pack model:

• Never-Expiring Credits: Purchased creative credits never expire, giving creators flexibility without artificial deadline pressure.
• Accumulation: New credit pack purchases add directly to your existing balance.
• Pricing Currency: All prices are displayed and billed in United States Dollars ($ USD) via certified PCI-DSS payment gateways.
• Refund Policy: Because generative compute generates immediate GPU infrastructure costs, credits consumed for successfully delivered images are non-refundable. If a verifiable system crash or service outage deducts credits without delivering your output, notify support@nanobananas.si within 14 days of the incident for a full balance restoration.

7. Disclaimers of Warranties & Cloud Retention Policy

The platform is provided on an "AS IS" and "AS AVAILABLE" basis. Generative neural networks operate probabilistically; while our infrastructure optimizes for high resolution and fidelity, we do not warrant that outputs will be error-free, suitable for particular specialized purposes, or completely uninterrupted by third-party upstream maintenance.

Image Retention Policy: Cloud-stored generated images are retained for 180 days. Images unstarred after 180 days may be automatically purged by routine maintenance. Artworks marked with "⭐ Star" are preserved permanently. Users are strongly advised to download high-resolution copies to their local devices immediately after generation.

8. Limitation of Liability

To the maximum extent permitted under applicable law, NanoBananas and its operators shall not be liable for any indirect, special, incidental, punitive, or consequential damages. In all scenarios, our aggregate cumulative liability shall not exceed the total fees paid by you to NanoBananas during the three (3) months preceding the event giving rise to liability.

9. Account Termination

You may close your account at any time via the /delete-account portal. NanoBananas reserves the right to suspend or terminate accounts that breach these Terms without prior notice or liability.

10. Dispute Resolution & Governing Law

These Terms are governed by general commercial principles. In the event of any disagreement, parties agree to first seek amicable, good-faith dispute resolution before resorting to formal arbitration or judicial proceedings.
